1. Acceptance of Terms

By accessing or using the Spreesy platform at spreesy.com (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

2. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Service. By creating an account, you represent that you meet these requirements.

3. Account Registration

You must provide accurate, complete, and current information when creating your account.
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
You must notify us immediately at [email protected] if you suspect unauthorized access to your account.

4. Subscription and Billing

4.1 Free Trial

We may offer a free trial period. A valid payment method is required to start the trial. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically begin and you will be charged the applicable fee.

4.2 Subscription Plans

Subscription fees are billed in advance on a monthly or annual basis, depending on the plan you select. All fees are stated in U.S. dollars and are non-refundable except as required by law or as described in Section 4.4.

4.3 Automatic Renewal

Your subscription automatically renews at the end of each billing cycle unless you cancel before the renewal date. You can cancel at any time from your account settings.

4.4 Refunds

If you believe you were charged in error, contact us within 14 days of the charge at [email protected]. We will review refund requests on a case-by-case basis.

4.5 Price Changes

We may adjust pricing from time to time. We will provide at least 30 days' notice before any price increase takes effect on your account.

5. Permitted Use

You may use the Service to:

Discover and identify creators for legitimate influencer marketing purposes.
Access creator contact information provided through the Service for direct outreach.
Manage and organize your creator lists and outreach workflows.

6. Prohibited Conduct

You agree not to:

Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
Resell, redistribute, or sublicense access to the Service or any data obtained through it.
Use automated tools (bots, scrapers, crawlers) to access the Service or extract data beyond normal use.
Send spam, unsolicited bulk messages, or any communication that violates applicable anti-spam laws (e.g., CAN-SPAM, GDPR) using contact information obtained through the Service.
Attempt to reverse-engineer, decompile, or disassemble any part of the Service.
Interfere with or disrupt the integrity or performance of the Service.
Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
Use creator contact information for purposes other than legitimate business outreach related to influencer marketing.

7. Intellectual Property

7.1 Our Property

The Service, including its design, software, algorithms, text, graphics, and branding, is owned by Spreesy and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our written permission.

7.2 Your Content

You retain ownership of any content you submit to the Service (e.g., product URLs, notes, lists). By submitting content, you grant us a limited license to use it solely to provide and improve the Service.

8. Creator Data

Creator profiles, contact information, and analytics displayed through the Service are compiled from publicly available sources and proprietary research. While we strive for accuracy, we do not guarantee that all creator data is complete, current, or error-free. You are responsible for verifying information before relying on it.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

The Service will be uninterrupted, timely, secure, or error-free.
Creator matches, fit scores, or contact information will result in successful partnerships or specific business outcomes.
Any information obtained through the Service is accurate or reliable.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPREESY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Spreesy and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion, with or without notice. Upon termination, your right to use the Service ceases immediately.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Delaware.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Spreesy regarding use of the Service.
